Terms & Conditions
The agreement between you and Moscherry-Lux when you order from us.
Effective 1 May 2026
About These Terms
These Terms form a binding agreement between you and Moscherry-Lux, an atelier registered in the Federal Republic of Nigeria, with its principal place of business at Rukpakwulusi New Layout, off East-West Road, Port Harcourt, Rivers State. By using this website or placing an order you accept these Terms.
Eligibility
You must be at least 18 and able to enter into binding contracts. You must provide accurate delivery and contact details, and accurate measurements for custom orders.
Orders
A submitted order is an offer to buy. The contract is formed when we send a written order confirmation by email. We may decline an order, including for stock, pricing errors or suspected fraud, and will refund any payment in full within 7 working days.
Pricing & Taxes
Prices are shown in your selected currency and include Nigerian VAT where chargeable. Customers outside Nigeria are responsible for any import duties or local taxes on arrival.
Custom Tailoring
Bespoke orders are produced to a written specification confirmed by you before cutting begins. Standard turnaround is 14 to 21 working days from sign-off, exclusive of shipping. Cancellation, modification and remake rules are set out in our Returns & Refunds policy and form part of these Terms.
Payment
Payments are processed by our PCI-DSS compliant partners (Paystack and Flutterwave) over TLS-encrypted channels. Moscherry-Lux does not see, transmit or store full card numbers, CVV codes, expiry dates or PINs.
Delivery & Risk
Title in the goods passes on delivery. Risk passes when the courier hands the package to you or to a person at the nominated address. Failed deliveries due to incorrect address details or refused customs charges are redelivered at the customer’s cost.
Intellectual Property
All site content is the property of Moscherry-Lux or our licensors and is protected by Nigerian and international copyright law. You may not reproduce or redistribute it without our prior written consent.
Acceptable Use
You agree not to scrape the site, place fraudulent orders, or interfere with our infrastructure. We may suspend or terminate accounts that breach this clause.
Liability
To the fullest extent permitted by Nigerian law, our aggregate liability for any claim arising out of an order is limited to the amount you paid for that order. Nothing in these Terms excludes liability that cannot be excluded by law.
Privacy
Personal data is processed in accordance with our Privacy Policy, which complies with the Nigeria Data Protection Regulation (NDPR) and the Nigeria Data Protection Act, 2023.
Force Majeure
We are not liable for delays or failures caused by events outside our reasonable control. Where a delay exceeds 30 days, you may cancel any unfulfilled portion of your order for a full refund.
Governing Law & Jurisdiction
These Terms are governed by the laws of the Federal Republic of Nigeria. The courts of Rivers State have exclusive jurisdiction.
Changes
We may update these Terms. The current version is the one published on this page. Material changes are notified to registered customers at least 14 days before they take effect.
